These Terms and Conditions cover all classes, parties, studio hire and any other activity provided by The Watermelon Studio (“TWS”). Before attending, you should read these Terms and Conditions carefully. If you find yourself unable to agree to them (in part or in full), you must not book or attend a class, submit a request for studio hire or enquire as to any other service offered by TWS.
By engaging TWS in any of their services, you will be deemed to have accepted the Terms and Conditions herein in their entirety. TWS reserves the right to amend these Terms and Conditions at any time. Nothing in these terms and conditions shall affect your statutory rights.
The following terms and conditions apply to all pole classes, workshops, parties, studio hire or other activities offered by TWS unless otherwise specified:
i) No observers shall be allowed into the studio during classes, workshops, studio hire or any other activity at TWS;
ii) No participant is to be under the influence of alcohol or drugs; those that are under the influence of alcohol or drugs shall be ejected from the studio and not offered a refund;
iii) You may not participate in any activity with TWS if:
a. You are injured;
b. You are pregnant;
c. You have given birth within the 6 weeks prior to your booked activity; or,
d. You have had a C-Section within the 12 weeks prior to your booked activity in each case doctor’s written approval will be required before you participate in any activity at TWS.
iv) By participating in any activity at TWS, you hereby give your consent to your image being taken in any digital format (including but not limited to photographs and videos) and for said image to be used on TWS’s website, all social media platforms and for marketing purposes;
v) It is an essential condition of booking that all participants take part in a warm-up before and cool-down after their booked activity. This is both for your safety and a requirement of the public liability insurance TWS maintains. Any participant who is not in attendance before the warm-up at the beginning of a booked activity starts, will not be allowed to take part and is asked not to disrupt the class. Participants are asked to arrive 5 minutes before their booked activity;
vi) No refunds, substitutions or transfers will be provided if a participant is late to their booked activity;
vii) All bookings are non-refundable including where a participant falls ill, travel disruptions and any reason out with TWS’s control;
viii) A participant may cancel their booking at any time by logging in to their account on the TWS booking site. If a participant cancels more than 24 hours in advance of their booked activity, they will be issued a credit to use towards an activity type of the same value;
ix) Credits are to be used within two (2) weeks of issue, after which they will expire. No refunds shall be provided for unused and expired credits;
x) No refunds, transfers or substitutions will be offered if any booked activity is cancelled with less than 24 hours’ notice;
xi) Participants must be 18 years or older;
xii) All bookings must be made through the TWS booking site. TWS will not accept any drop-ins or cash payments;
xiii) Participants must fill in a health and safety form before their first booked activity and annually thereafter. Participants will not be allowed to attend any activities at TWS without having first completed a health and safety form;
xiv) Participants must provide TWS instructors with information about any injuries sustained before taking part in any booked activity;
xv) Pole classes, workshops, studio hire and all other services offered by TWS are done so on a first come first serve basis through the booking site;
xvi) TWS management and instructors reserve the right to refuse places to, or request a participant leaves, an activity at their discretion;
xvii) Abuse in any form will not be tolerated and any participant who abuses TWS management or instructors will be asked to leave and shall, at the sole discretion of the TWS management, have their account closed and shall be refused entry to the TWS premises;
xviii) Booking an activity with TWS implies the participant will follow all instructions given by TWS instructors. A booking can be terminated during a class if any behaviour causes, or could cause, an unsafe or disruptive environment for the other students. This is down to managerial discretion and no refunds will be given;
xix) All participant personal property and belongings are brought to and/or left at the TWS studio entirely at the -participant’s own risk. TWS does not accept any responsibility for the loss of or damage to any personal property or belongings of a participant;
xx) TWS does not accept any liability for personal injury to or death of a participant other than that caused by the negligence of TWS or its instructors.
xxi) TWS reserves the right to vary, amend, update or rewrite these terms and conditions at their sole discretion.
i) All block bookings are valid for one month;
ii) Block bookings cannot be transferred, extended or refunded if you do not use all credits within the one month period. This shall be applied without exception.
iii) In the event of another lockdown (due to government mandate only) participants who have purchased a block shall have their credits automatically converted to online credits (being credits for use in online classes), which are to be used within the same expiry dates. These will not be transferred back.
Pole Practice:
i) Participants shall use pole practice sessions to use TWS poles to practice moves taught to them by TWS instructors only. A participant shall not attempt a move unless they have been taught it by a TWS instructor. Participants shall not attempt to perform moves they are unsure of;
ii) Participants cannot attempt inverted moves without a mat AND spotter unless told otherwise by an instructor;
iii) If a participant is seen to be putting themselves or anyone else at risk they will be asked to leave with no refund;
iv) Pole practice sessions are not a teaching environment. For the avoidance of doubt, participants are not to teach each other new moves and TWS instructors are present only for the health and safety of participants, not to provide direction on new moves.
i) In the unlikely event TWS cancels an activity, credits or refunds will be issued to affected participants other than cancellation due to i) Acts of God which include storms, flooding, fire or snow (ii) Force Majeure which includes war, accidents, strikes, local disputes and civil commotions and (iii) Power failure and failure of sound or lighting;
ii) TWS will not accept liability for any losses incurred by a participant ancillary to a cancellation either by TWS, the participant, or the act or omission of a participant, including but not limited to travel and accommodation costs.
i) Conditions viii, ix and x in “General” do not apply to workshop bookings. For the avoidance of doubt, all other Conditions in “General” shall apply to workshop;
ii) Participants accept that all workshop bookings are made on a no refund basis;
iii) Workshop bookings may not be transferred or substituted.

ii) Parties must have a minimum of 6 paid participants. In the event less than 6 participants attend the booking, no refunds shall be given for the missing participants;
iii) It is an essential condition that all participants take part in a warm-up before and a cool-down after the party session. This is both for your safety and a requirement of the public liability insurance TWS maintains.
iv) Participants are asked to arrive 15 minutes before their party session to allow for completion of administrative tasks, including completion of any outstanding health and safety forms. For the avoidance of doubt, the party session will not commence until all participants have completed a health and safety form and clause v of this section shall apply;
v) Party bookings are for an allocated time slot which is non-negotiable. If participants arrive late (which includes the completion of administrative tasks referred to in clause iv above), time will not be added to the session and aspects of the session will be modified/shortened to suit the remaining time. In the event participants arrive to their booking more than 30 minutes late, TWS reserve the right to cancel the party session without refund;
vi) Party sessions are booked on a non-refundable basis;
vii) A 50% non-refundable deposit is payable at the time of booking. The outstanding balance is to be paid in full no later than one month in advance of the party session date. If the outstanding balance is not paid as aforementioned, the party session will be cancelled.
i) Refunds will only be given for purchases made either at TWS premises or online if the item purchased is faulty;
ii) TWS shall use reasonable endeavours to dispatch all orders within 2 weeks;
iii) Collection from the studio can be arranged, subject to availability.
i) Condition v in “General” shall not apply to RH bookings. For the avoidance of doubt, all other Conditions in “General” shall apply to RH bookings and all other conditions shall be read so as to substitute the word “hirer” for the word “participant”;
ii) RH sessions are for regular TWS students only and shall be limited to a maximum of 1 person in the Pip Room only;
iii) RH sessions are unsupervised and TWS shall be under no obligation to provide an instruction to assist the hirer.
iv) All RH sessions are for one hour only. The hirer must arrive 5 minutes before their session begins to allow time to be given access to the Pip Room;
v) The hirer accepts that they are responsible for carrying out appropriate warm up at the beginning of their session and cool down at the end of their session;
vi) The hirer shall use RH sessions to use TWS poles to practice moves taught to them by TWS instructors only. The hirer shall not attempt a move unless they have been taught it by a TWS instructor. The hirer shall not attempt to perform moves they are unsure of;
vii) The hirer cannot attempt inverted moves without a mat;
viii) If the hirer is seen to be putting themselves at risk, they will be asked to leave without refund;
ix) If the hirer is practising any heel work/routines, they must ensure they are comfortable and secure in their heels;
x) Only Pleasers or Hella Heels are allowed in a RH session;
xi) The hirer shall not consume food or drink (other than water) in the Pip Room;
xii) The hirer shall be liable for all damage caused to the Pip Room during their session;
xiii) The hirer shall leave the Pip Room in a clean and tidy condition.
i) TWS operates a CCTV system in the reception area, main studio and Pip Room. This system is present for safety and insurance purposes.

i) These terms and conditions shall be governed by the law of Scotland and any dispute arising here from or in connection with any dispute in which TWS is engaged shall be subject to the jurisdiction of the Scottish courts.

These Terms and Conditions cover all memberships provided by The Watermelon Studio (“TWS”). Before taking out a membership with TWS, you should read these Terms and Conditions carefully. “Membership” means the membership taken out by a student of TWS regardless of the level of membership;
“Payment Date” means the 25th of each calendar month;
“General Terms and Condition” means the TWS Terms and Conditions located at the top of the page;
The General Terms and Conditions shall apply to these terms and conditions. In the event the General Terms and Conditions are inconsistent with the terms and conditions contained herein, these terms and conditions shall prevail.
i) By setting up a Membership, the student agrees (i) to these terms and conditions and the General Terms and Conditions, and (ii) to allow TWS to charge the selected payment method on a recurring, monthly, offline basis. The student will only be charged for payments for the Membership chosen.
ii) Payment for a Membership shall be taken on the Payment Date in each calendar month via the student’s selected payment method;
iii) If TWS attempt to take payment for a Membership and the payment method fails, the student will receive an email with a link to update their payment information and retry the payment. If payment has not been made by or on the 28th of the month, the Membership will be cancelled, along with any bookings the student has made for the coming month.
iv) TWS reserves the right to change the prices of the Memberships at any time;
v) In the event TWS exercises their right under paragraph (iii), the new price shall come in to affect the month thereafter;
i) Duration and Cancellation;
ii) Students will have the option to commence a Membership at any date in the current month, or to start from the subsequent month;
iii) If the student elects to start their Membership in the current month, the full monthly payment will be taken immediately, and the entire month's membership allowance will be made available to use until the end of the month. Allowances and payments are not prorated should the student choose to start their Membership part-way through a month.
iv) A Membership can be cancelled or changed by the student at any time and shall expire on the last day of the month in which the cancellation is processed.
v) To cancel a Membership, a student will need to log into ‘My Account’ and follow the steps;
vi) Membership allowance shall reset on the 1st day of each month. Any unused credits shall not rollover in to the next month;
vii) No refunds shall be given for any unused credits;
viii) In the event a student is found to be in breach of the General Terms and Conditions, TWS reserves the right to cancel a Membership forthwith without refund or other compensation due to the student;
ix) In the event a student is found to be in breach of the General Terms and Conditions, TWS reserves the right to cancel a Membership forthwith without refund or other compensation due to the student.
i) A Membership allowance shall consist of credits which can be used in the calendar month in which the are issued;
ii) Students can book their desired classes through the TWS website in the normal manner using the credits as payment;
iii) Should a student wish to book more than their Membership allowance, they will have the option to purchase a block or individual classes to top up for that month.
iv) Purchasing a Membership does not in any way guarantee a space in classes. The timetable is checked regularly to open more spaces when able, although this is at TWS’s discretion;

vi) If the student requires to cancel a booking, they must do so via ‘my blocks and bookings’ with no less than 24 hours’ notice. If cancelled in a timely manner (and only if), the student will receive a credit note for the same month of the Membership; if the credit note is not used before the end of the month, the student will lose the credit.
